Terms and Conditions
These are the terms and conditions of sale ("Terms of Sale") which apply to your purchase of goods from Kohatu + Petros. Kohatu + Petros is referred to in these Terms of Sale as "we", "us" and "our". When we refer to "you" or "your" we mean the user of this website and purchaser of goods. We reserve the right to change the Terms of Sale at any time. Any changes to the Terms of Sale will be effective for all new orders placed after the changes are published on our website.
Making a Purchase
Kohatu + Petros Jewellery accepts payments via Visa, Mastercard, American Express, Visa Debit, Mastercard Debit, PAYPAL
Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order. All payments are in UK pounds. If you are shopping from anywhere else, place your order and your credit card company will convert the transaction to your own currency. Currency fluctuations and credit card charges may make a difference to the amount billed on your credit card or displayed using a currency converter.
Once payment has been received by us we will send an order acknowledgment e-mail to you at the e-mail address you provide in your order form. The order acknowledgment e-mail is simply an acknowledgement that your order has been received by us and it is not an acceptance of your order by us and does not form a binding contract. If you have made any error in your order or wish to change or cancel your order please contact us by email to firstname.lastname@example.org .
Acceptance of your order will only take place when we dispatch the goods to you. Our acceptance of your order brings into existence a legally binding contract between us. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable. Only adults (persons aged 18 and over) are entitled to enter into legally binding contracts and as a result are the only people entitled to transact through this site. Any other individuals who are unable to perform legally binding contracts are prohibited from ordering goods using this site. If you do not qualify do not use this site.
We make every effort to ship goods within 1-3 days of order placement. Outside of the UK the delivery should arrive within 5-10 working days from shipping date. If there is going to be a delay beyond this you will always be e-mailed with the reason and a schedule. We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. The first order you place with us must always be delivered to the address matching your bank card. It is your responsibility to ensure that the delivery address you give us is correct and accurate and that there is somebody to sign for and take delivery of the goods from the delivery service used. All orders within the UK are delivered using Royal Mail signed for or Special Delivery. All items sent via Royal Mail Special Delivery are insured. If an item is lost in the post and delivery has not been made and this can be verified by Royal Mail Kohatu + Petros will replace the goods with no charge to the customer.
You will become the owner of the goods you have ordered when they have been dispatched to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction. We make no promise that materials on our website are appropriate or available for use in locations outside the United Kingdom, and accessing the website from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do at your own initiative and are responsible for compliance with local laws. If your order is returned to us because the courier or postal service could not complete the delivery to you for whatever reason, then you will be responsible for the repeat delivery costs. Right for you to cancel your contract Subject to the conditions below, you may cancel your contract with us for the goods you order at any time up to the end of the seventh working day from the date you receive the ordered goods. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty. To cancel your contract you must notify us by e-mail at email@example.com . Your right to cancel your contract with us for the goods you have ordered is subject to: a) you not having worn or damaged the jewellery. b) you having not removed the security tag from the item. c) you e-mailing or calling us within 7 days of receiving your goods and being given a 'Returns Authorization Number'. Please note that we cannot offer exchanges or refunds for earrings for pierced ears for health and hygiene reasons, as well as on personalized and items made to your specification. This does not affect your statutory rights.
To return your item within the UK: Email firstname.lastname@example.org within 7 working days of receipt of purchase and ask for a 'Returns Authorisation number'. Your 'Returns Authorisation number' should be included with the returned item. You are liable for the cost of returning the item(s) to us. We recommend that items are returned to us using Royal Mail Signed for. The item(s) must be packed securely in a similar manner to the packaging in which you received it. We are not liable to refund you if the jewellery is returned to us broken. Once we have received the item(s) we will refund the amount due to your credit card. There is no charge for returning items from the UK.
To return your item from overseas: Email email@example.com within 7 working days of receipt of purchase and ask for a 'Returns Authorisation number'. Your 'Returns Authorisation number' should be included with the returned item. You are liable for the cost of returning the item(s) to us. We recommend that items are returned to us using Royal Mail Special Delivery. The item(s) must be packed securely in a similar manner to the packaging in which you received it. We are not liable to refund you if the jewellery is returned to us broken. Once we have received the item(s) we will refund the amount due to your credit card.
Kohatu + Petros do not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party. Emails are only stored by us and sent to you, if we have been given your permission.
Cancellation by us
We reserve the right to cancel the contract between you and us if: - we have insufficient stock to deliver the goods you have ordered; - we do not deliver to your area; or - one or more of the items you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers. If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
Damage and Repairs
In the event of damage to your jewellery Kohatu + Petros will endeavour to repair or replace the jewellery at the customers expense. These Terms of Sale are governed by the laws of England and Wales and any dispute between us arising out of them shall be brought in a court in England or Wales.
